BRUCE’S NEW SUIT

Though a dozen buildings are already being prepared for demolition, the war between Bruce Ratner and Develop Don’t Destroy Brooklyn wages on. The group is filing its third lawsuit against developer Forest City Ratner, the Empire State Development Corp., Public Authorities Control Board and the Metropolitan Transit Authority in what will not likely be their final attempt to halt the $4 billion Atlantic Yards project. The latest suit charges that the new arena planned for the NBA’s New Jersey Nets does not meet the definition of a civic project, and seeks to have the environmental review and approval of the project annulled and a preliminary injunction enforced to prevent it from proceeding. If successful this time around, the Spitzer administration may be compelled to do a new review of the project.
